Since last year’s ASCP Annual Meeting, several significant federal policy proposals or final regulations have been released that have or would significantly impact pathology and laboratory medicine. ASCP and the ASCP BOC secured a major advocacy victory when the Centers for Medicare & Medicaid Services (CMS) released a final rule abandoning its plans to add Bachelor of Nursing degrees as qualifying degrees for high complexity testing under the Clinical Laboratory Improvement Amendments (CLIA). CMS also adopted several other ASCP/ASCP BOC recommendations. In addition, the Food and Drug Administration (FDA) released its final rule claiming oversight authority over laboratory developed tests. This rule will have profound implications for patient care and laboratory operations if it withstands judicial scrutiny in the pending lawsuit. Even if the Final Rule is overturned, future Congressional action such as the VALID Act could further impact clinical laboratories’ ability to offer LDTs. Faculty will discuss litigation against the FDA, the possibility of new legislation, and how is ASCP is helping to shape these initiatives. In addition, ASCP has been advocating to fix flaws in Medicare’s physician and laboratory fee schedules, which private payers also use to identify their payment. Speakers will address these policies and outline the real-world implications for how they will impact patient care and laboratory operations.
